Matthew J. Murry Jr. said he crashed his vehicle on Pettis Road in Wilton just after 4:30 p.m. on Wednesday, Aug. 6, the Saratoga County Sheriff's Office said. He told police he swerved to miss a deer, struck a utility pole, and rolled the truck.

Two boys — ages 10 and 7 — were ejected from the truck's bed at the time of the crash. Paramedics rushed both of them to Albany Medical Center. The 10-year-old broke his arm and collarbone in the wreck.

Doctors were treating the 7-year-old for non-life-threatening injuries, the Sheriff's Office said. A 22-year-old in the front seat of the 2014 Dodge pickup was not hurt.

Murry is charged with:

  • Vehicular assault in the first degree
  • Driving with a blood alcohol content of .08 percent or higher
  • Aggravated DUI (two counts)
  • Endangering the welfare of a child (two counts)
  • Multiple traffic infractions

A judge ordered Murray held in Saratoga County jail without bail, deputies said.
